Step 2: Prepare and file Form TM-O (Notice of Opposition) within 4 months of the publication date. The form must state the grounds of opposition and the opponent's interest. The filing fee is ₹2,700 per class online (₹3,000 offline).

Step 3: The Trademark Registry serves the notice on the applicant, who has 2 months to file a counter-statement (Form TM-O counter-statement). If the applicant does not file a counter-statement, the application is treated as abandoned.

Step 4: Both parties file evidence by way of affidavit. First the opponent files evidence in support of opposition, then the applicant files evidence in support of application, followed by the opponent's reply evidence.

Step 5: Hearing before the Registrar or Hearing Officer. After hearing both sides, the Registrar passes an order either accepting or rejecting the opposition.

How to Respond to a Trademark Opposition
