Every commercial establishment in Kerala — shops, offices, trading premises, warehouses — must be registered under the Kerala Shops and Commercial Establishments Act, 1960 (KSCEA). This registration is one of the most fundamental business licences for any business operating from a physical location in Kerala. Here is everything you need to know.

Who Must Register?

The Kerala Shops and Commercial Establishments Act applies to:

  • All shops — retail and wholesale — selling goods or providing services
  • Commercial establishments — offices, insurance companies, trading companies, banking companies, hotels, clubs, restaurants, etc.
  • Warehouses and godowns used in connection with a commercial establishment
  • Theatres, cinemas and places of entertainment

The Act does NOT apply to: government offices, factories covered under the Factories Act, certain agricultural establishments, and railway canteens.

How to Register — Online Process

Kerala has moved to online registration through the Kerala Single Window Interface for Fast and Transparent Clearance (SWIFT) portal (serviceonline.gov.in or through the Labour Department portal). The process:

  • Create an employer account on the Kerala Labour Department portal
  • Fill in the application with: establishment name, address, type of business, number of employees, owner details
  • Upload documents: identity proof of owner, proof of premises (rental agreement or ownership document), PAN card, and shop photos
  • Pay the registration fee (varies by category and number of employees — typically ₹200 to ₹2,000 for small establishments)
  • The Labour Inspector may conduct a site inspection before issuing the certificate

Key Rules Under the Kerala Shops and Establishments Act

Working Hours: Employees cannot work more than 9 hours per day or 48 hours per week. Overtime is permitted up to 10 hours per day with overtime pay (1.5x normal wages). Spread-over of work should not exceed 12 hours.

Weekly Rest Day: Every employee must be given one day off per week. The establishment must remain closed on that day (unless it has specific exemption for 7-day operation).

Leave: Employees are entitled to annual leave with wages (1 day for every 20 days worked). Sick leave: 8 days per year. Casual leave: 8 days per year (varies).

Opening Hours: Establishments must not open before 7:00 AM or remain open after 10:00 PM (general rule — specific rules apply for different categories and areas). Malls and certain commercial establishments have different permitted hours.

Annual Renewal

The registration must be renewed annually before 31 January of each year by paying the renewal fee and updating employee count and other details. Non-renewal makes the business technically unregistered, which can attract penalties during inspections.
