What Can Be Registered as a Design?

Design Registration vs Trademark Registration
Design registration protects the visual appearance of a product (shape, pattern). Application Process for Design Registration
Applications are filed with the Office of the Controller General of Patents, Designs and Trade Marks in Kolkata (the Design Registry) or online through the IP India portal (ipindiaonline.gov.in).
- File the application with clear representations (drawings or photographs) of the design from multiple views
- Specify the article to which the design is applied and the Locarno Classification
- Pay the prescribed fee (varies by entity type — individual/startup/SME: ₹1,000; large entity: ₹4,000)
- The Design Office examines the application for novelty and formality compliance
- If accepted, the design is registered and a Registration Certificate is issued
Term of Protection
A registered design is protected for an initial period of 10 years from the date of registration. This can be extended by one further period of 5 years on payment of the prescribed fee — giving a total protection of 15 years. After this, the design enters the public domain.
